In these Terms, “Malibu Strings,” “we,” “us,” and “our” refer to that company. These Terms explain the conditions for using our website, purchasing our products, and submitting material to us. When we present these Terms and ask you to expressly accept them, your acceptance forms an agreement with us. Who may use our services Our website features adult swimwear and adult modeling images, including nudity, and is intended for adults. You must be at least 18 and legally able to enter a contract to place an order or submit material for publication. Everyone depicted in a modeling submission must have been at least 18 when the images or video were created. Orders and product information Please review your selected style, size, color, quantity, shipping address, and order total before purchasing. Our garments are handmade to order. Measurements may vary within the tolerances described for a product, and the appearance of colors can vary between screens. These variations do not excuse supplying an item that materially differs from its description. Prices are in U.S. dollars unless stated otherwise. Applicable taxes and shipping charges are disclosed before you place your order. Prices include mandatory charges that applicable law requires us to include in the advertised price. Optional customization charges are disclosed before you authorize them. If we discover an availability, description, or pricing error affecting an order, we will contact you to resolve it. We will not substitute a materially different product or increase your authorized charge without your agreement. If an order is canceled, we will refund any payment due for the canceled items and associated charges as required by law. Please review it before purchasing. Delivery estimates depend on the destination and shipping method. If we cannot ship within the time promised when you ordered, we will notify you, explain the expected delay, and offer the choice of agreeing to the delay or canceling the affected order for a prompt refund. We will obtain any consent required by law and cancel and refund the affected order when required consent is not obtained. A final-sale policy does not eliminate these rights. International orders may be subject to import duties, taxes, or carrier charges imposed at the destination. Final sales and the Remake Program Because our garments are made to order and are intimate apparel, we do not offer discretionary refunds or traditional exchanges for a change of mind or a sizing preference. Garment sales are final, subject to the exceptions below and any rights that applicable law gives you. If an item does not fit as expected, our Remake Program allows you to purchase the same item in a different size at a 70% discount from its original price. You keep the original garment. The final-sale policy and Remake Program do not replace your rights concerning defective, damaged, incorrectly supplied, or materially misdescribed goods, or any refund or cancellation right required by law. We do not require you to purchase a remake to obtain a remedy to which you are otherwise entitled. Gift certificates are subject to their disclosed terms and applicable law, including any mandatory cash-redemption rights. The garment final-sale policy does not override those rights. Website content and permitted use Our website design, product descriptions, photographs, videos, logos, and other content may be protected by copyright, trademark, and other laws. Rights belong to Malibu Strings or the respective rights holders. You may view the website and keep copies reasonably needed for personal shopping and recordkeeping. Except where the law permits it, you may not reproduce, republish, distribute, sell, or commercially exploit website content without permission from the relevant rights holder. No trademark or other ownership right is transferred to you by using the website. These Terms do not restrict fair use or other legally protected uses. Customer photos and videos Sending us a photograph or video does not, by itself, transfer its copyright to us. Publication and promotional use require appropriate permission from the copyright owner and each identifiable person depicted. If you did not take an image yourself, permission from the photographer may be required even if you are the person pictured. When you submit material for consideration, you authorize us to receive and review it for that purpose. Any permission to publish, edit, advertise with, or otherwise reuse it must be recorded in the submission agreement or another express agreement accepted by the necessary rights holders.
